Combined Notice of Finding of No Significant Impact and of Intent to Request a Release of Funds


On or about June 1, 2011, the City of Portland, as lead entity for the Portland/Cumberland County HOME Program Consortium, will submit a request to the U.S. Department of Housing and Urban Development (HUD) Manchester, NH Field Office for the release of HOME Program funds under Title II of the Cranston Gonzalez Affordable Housing Act of 1996, as amended, to undertake the project described below.

Freeport Housing Trust – Oak Leaf 2 Senior Housing: Construction of 25 units of Senior Housing, 24 South Street, Freeport, Maine. Approximate total cost $5,117,500.00. HOME Program Grant $118,994.00

Finding of No Significant Impact
The City of Portland has made an environmental assessment for this project and has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 is not required. Public Comments
Any individual, group, or agency, may submit written comments on the ERR to the City of Portland, Division of Housing & Neighborhood Services, 389 Congress Street, Portland, Maine 04101. All comments received by May 31, 2011 will be considered by the City of Portland prior to authorizing submission of a request for release of funds.

Release of Grant Funds
City of Portland certifies to HUD that Patricia Finnegan in her official capacity as Acting City Manager consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and allows the City of Portland to use HOME program funds.

Objections to Release of Funds
HUD’s Region I, Boston, MA office will accept objections to its release of funds and the City of Portland certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it is on one of the following bases: (a) the certification was not executed by the Chief Executive Officer of City of Portland; (b) the ERR indicates omission of a required step, decision or finding required by HUD regulations at 24CFR part 58; (c) the grant recipient or other participants in the project has committed funds and incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the HUD Region I, Boston, MA office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58.76) and shall be address to U.S. Department of Housing and Urban Development, 10 Causeway Street, Boston, MA, 02222-1092.
