1. WORKSHOP- 3:30 p.m.

i. Baxter Building Site Plan and Change of Use; Vicinity of 621 Congress Street; Archetype, Applicant. (3:30- 4:30 PM- estimated time, subject to change) A proposal for a change of use to office use along with an 896 sq. ft. addition at 621 Congress Street.

ii. Nonconforming Use Text Amendment; Oliver Keithly, Applicant. (4:30- 5:30 PM- estimated time, subject to change) A proposal to allow nonconforming uses discontinued during renovation, reconstruction or partial reconstruction in non- residential zones to be deemed continuing uses. This would allow the legally non-conforming use at the former Boone's Restaurant at 20 Custom House Wharf to be re-established.

4. REPORT OF DECISIONS AT THE PREVIOUS MEETING, HELD ON JANUARY 27th, 2009.

i. Request for Reconsideration, Walgreens Pharmacy Conditional Use and Site Plan; Vicinity of 340 Allen Avenue, Richmond Company, Applicant. The applicant withdrew this request.

ii. Congress Street Historic District; Amendments to Land Use Code; City of Portland, Applicant. The Planning Board voted 5-2 (Lewis, Odokara opposed) to recommend the proposed Congress Street Historic District Designation. The Planning Board voted 5-2 (Lewis, Odokara opposed) to recommend the amendments to the Historic Preservation Ordinance, subject to one revision to the recommendation. The Planning Board voted unanimously 7-0 to recommend the amendments to the Site Plan Ordinance subject to two revisions to the amendments.

iii. Crescent Heights, Site Plan; Vicinity of 29 Crescent Street; Crescent Heights, LLC, Applicant. The Planning Board voted unanimously 4-0 (Silk recused, Odokara and Hall absent) that the project meets the Standards of 14-483, Preservation and Replacement of Housing Unites. The Board voted unanimously 4-0 (Silk recused, Odokara and Hall absent) to approve waivers of driveway width and separation and to waive the technical standards regarding light levels on the westerly property boundary. The Planning Board voted unanimously 4-0 (Silk recused, Odokara and Hall absent) to approve the site plan subject to ten conditions of approval.

New Business

i. St. Patrick’s School Conditional R-5 Rezoning; Vicinity of 1257 Congress Street; Westbrook Development Corp., Applicant. (7:00- 8:00 PM- estimated time, subject to change) A proposal for a conditional R-5 rezoning of 1257 Congress Street to allow a greater housing density on the site for 15 housing units of which 5 units will be permanently affordable condominiums.

ii. Berlin City Toyota, Site Plan; Vicinity of 191 Riverside Street; Berlin City, Applicant. (8:00- 8:45 PM- estimated time, subject to change) A proposal to construct a 9,312 sq. ft. bld. addition as well as expand the vehicle inventory storage area.

iii. Residence Professional R-P Text Amendment; ATH, LLC, Applicant. (8:45- 9:30 PM- estimated time, subject to change) A proposal to allow funeral homes as a permitted or conditional use in the Residence- Professional (R-P) zone.

iv. B2 Rezoning, Map Amendment; Vicinity of 1884 Forest Avenue; John Chau, Applicant. (9:30- 10:00 PM- estimated time, subject to change) A proposal to amend the current R-5 zone to B-2 to allow a retail/office building and a gas station at 1884 Forest Avenue and to rezone a portion of the B-2 zone that is developed as housing to Residential R-5.
