1. WORKSHOP- 3:30 PM

i. Ocean Avenue School; Vicinity of Ocean Avenue; City of Portland, Applicant. (3:30- 4:30PM- estimated time, subject to change) A proposal by the School District and the City of Portland to construct an approximately 73,960 square foot elementary school building with attendant parking , walks, stormwater management infrastructure, and play areas on a +/-12 acre site at 152 Ocean Avenue. The playing area will consist of an all purpose field, a paved area for basketball and outdoor games, and four (4) play areas. This parcel is the site of the Baxter School. The project will be reviewed for compliance with the City’s Site Plan Ordinance and as a Site Location of Development Project.

ii. Stormwater Management Standards and Site Plan Amendments; City of Portland, Applicant. (4:30- 5:30 PM- estimated time, subject to change) Review of proposed stormwater management standards to replace Portland’s current standards in the City’s Technical and Design Standards and Guidelines.

4. REPORT OF DECISIONS AT THE PREVIOUS MEETING, HELD ON JULY 22nd, 2008.

i. True Street Subdivision; Vicinity of 41 True Street; Nick and Amanda Kent, Applicants. The Planning Board voted unanimously 5-0 (Odokara, Lewis absent) to waive the sidewalk on the south side of True Street. The Planning Board voted unanimously 5-0 (Odokara, Lewis absent) to approve the subdivision subject to 5 conditions of approval.

ii. Yale Street Subdivision; Vicinity of Yale Street; MJ Development Co., Applicant. The Planning Board voted unanimously 5-0 (Odokara, Lewis absent) to approve the subdivision subject to 3 conditions of approval.

iii. Skylark Commons Subdivision; Vicinity of Skylark Road; Frank DiDonato, Applicant. The Planning Board voted unanimously 5-0 (Odokara, Lewis absent) to grant a sidewalk waiver on the south side of Skylark and the north side of Coolidge Avenue. The Planning Board voted unanimously 5-0 (Odokara, Lewis absent) to approve the subdivision subject to 10 conditions of approval.

iv. Appeal of Historic Preservation Board Decision; Vicinity of 98 Pleasant Street; Michael Costin, Applicant. The Planning Board voted unanimously 5-0 (Odokara, Lewis absent) that the decision of the Historic Preservation Board was based on evidence in the record and was not arbitrary or capricious.
3. Unfinished Business

i. Request for reconsideration of a condition of approval for Yale Street Subdivision; Vicinity of Yale Street; MJ Development Co., Applicant. (7:00- 7:30 PM- estimated time, subject to change) The applicant seeks to clarify whether the Board’s second condition of approval includes a requirement that plantings be included between the residential lots.
4. NEW BUSINESS

i. Amended Conditional Use/ Site Plan for Tim Horton’s Restaurant; Westgate Shopping Center, Vicinity of 1354 1422 Congress Street; Charter Realty, Applicant. (7:30- 8:15 PM- estimated time, subject to change) The applicant is proposing to reuse the former Friendly’s building which includes a drive-thru window on the north side and a redesign of the parking layout, site circulation, lighting and landscaping.

ii. B-2 Map Amendment; Vicinity of 17 Bishop Street; Spurwink School, Applicant. (8:15- 9:00 PM- estimated time, subject to change) The applicant is proposing to change from I-M to B-2 to allow the Spurwink facility on Bishop Street to create one or two living units for children.

iii. Bayside TDM Ordinance; City of Portland, Applicant (9:00 PM- estimated time, subject to change) Review of a Transportation Demand Ordinance for the B-7 zone in the Bayside Neighborhood.
NOTE: It is possible that the Board will not reach all of the items prior to adjournment. Any items not reached will be rescheduled to appear on the subsequent agenda with items appearing early on the agenda as unfinished business.
