4. REPORT OF DECISIONS AT THE PREVIOUS MEETING, HELD ON APRIL 8th, 2008.

i.Morning Star Lane Subdivision; Subdivision Review of a proposal for 10 single family house lots and new 700 foot long street; Vicinity of Summit Street; Morning Star Real Estate Trust, Applicant.

A waiver of a portion of the sidewalk was found to meet waiver criteria C and F and the Board voted unanimously (5-0, Odokara and Hall absent). The Board voted unanimously (5-0, Odokara and Hall absent) to approve the Morning Star Lane subdivision, subject to seven conditions of approval.

New Business

i. A proposed rezoning from R-6 to conditional R-7 for 51-59 Danforth Street. The proposed rezoning would permit the construction of 43 residential apartments above one level of structured parking with a total of 38 spaces. The rezoning includes revised dimensional requirements to allow the 43 residential units, to allow a maximum building height of 54’8” feet and to adjust the side yard setback for the proposed building. The conditional rezoning will also set the number of parking spaces required for the residential units and set the driveways width; Vicinity of 51-59 Danforth Street; Maine Workforce Housing, Applicant

ii. A proposal for a 13,700 sq. Ft. Walgreen's Pharmacy with drive-up service; Vicinity of 606-616 Forest Avenue; The Richmond Company, Applicant.

iii. A proposal to amend the conditional rezoning agreement adopted in 2007 for the Village at Oceangate, 112 Newbury Street. The applicant is requesting an amendment to the conditional zoning agreement to add 1,602 square feet of land to the Phase I portion of the development, to increase the number of units in Phase I from 84 to 90 units, to modify the parking plan and to reduce the amount of commercial space from 6,772 to 5, 700 square feet; Vicinity of 112 Newbury Street; The Village at Ocean Gate, LLC, Applicant.

NOTE: It is possible that the Board will not reach all of the items prior to adjournment. Any items not reached will be rescheduled to appear on the subsequent agenda with items appearing early on the agenda as unfinished business.
