October 11th Workshop – Morrissette, O’Brien, Patterson and Silk present; Lewis and Hall absent; Lowry recused) 4. REPORT OF DECISIONS AT THE PREVIOUS MEETING HELD ON SEPTEMBER 27, 2011: i. Canal Plaza Conditional Rezoning; One Canal Plaza; Tim Soley, East Brown Cow Management, Applicant. The Board voted 0-4 (O’Brien, Morrissette and Hall absent) on a motion to recommend the proposed conditional rezoning to the City Council, therefore the motion failed. The Board voted unanimously 4-0 (O’Brien, Morrissette and Hall absent) on a motion to recommend the additional height provisions of the conditional rezoning, subject to provisions that would preserve the plaza as open space. ii. Appeal of 25 and 27 Dakota Street, Level I Minor Residential Site Plans, Diversified Properties, Inc. Applicant. First Appeallant: Sue Ann Nolan, 135 Maine Avenue, Portland; Second Appellant; Theresa E. Geissler, 12117 Sandy Court, Herndon, VA owning Tax Assessor lots 406-H-17 and 407-H-28. The Board voted unanimously 4-0 (O’Brien, Hall and Morrissette absent) to approve the plan subject to six (6) conditions of approval. 5. NEW BUSINESS i. Appeal of Administrative Determination; Taft Avenue, Francis P. Drake, Applicant. (6:30 -7:15 p.m., estimated time subject to change). The Planning Board will hold a public hearing to consider an appeal of a Planning Authority Determination that an amended Level I: Minor Residential Plan and a Level II site plan review are required for the removal of trees in the vicinity of Taft Avenue.
