1. WORKSHOP - 3:30 p.m.

i. Contract Zone; One Canal Plaza; Cow Plaza LLC, Applicant. (3:30 p.m.- 4:30 – estimated time subject to change) The Portland Planning Board will hold a workshop to consider a proposal by East Brown Cow Management, Inc. (Tim Soley), representing Cow Plaza LLC., for a conditional Downtown Business B-3 zone for One Canal Plaza property at the intersection of Middle and Union Streets. The proposal amends the Downtown Height Overlay Zone to allow a maximum height of 150 feet for one building, a maximum height of 100 feet for a second building, a single story construction for a building in the center plaza, and elimination of the maximum building setback for the plaza.

ii. Shoreland Zone Text Amendment; City of Portland, Applicant. (4:30-5:30 p.m. – estimated time subject to change) The Portland Planning Board will hold a workshop to consider text amendments proposed by the City of Portland Dept. of Planning and Urban Development that address pier setback provisions of the Eastern Waterfront Port Zone; high water setbacks for buildings, parking and roadways in the Shoreland Zone portions of the B-5, B-5b, B-6, B-7, I-L and I-M zones; and clearing of vegetation standards in the Shoreland Zone portions of the B-5, B-5b, B-6, B-7, I-L and I-M zones.

Public Hearing: Lewis, Morrissette, Lowry and Hall present; O’Brien, Patterson and Silk absent.

4. REPORT OF DECISIONS AT THE PREVIOUS MEETING HELD ON JUNE 28, 2011:

i. 127 York Street; 7 Residential Units (Harborview Townhouses) Subdivision and Site Plan with a 19 space Parking Lot; Redfern Properties, Applicant. The Board voted unanimously 4-0 (Silk, Patterson and O’Brien absent) to approve the subdivision, subject to five (5) conditions of approval; and voted unanimously 4-0 (Silk, Patterson and O’Brien absent) to approve the site plan subject to seven (7) conditions of approval.

ii. Technical Manual Updates and Text Amendments to Article V, Site Plan of the Land Use Code The Board voted unanimously 4-0 (Silk, Patterson and O’Brien absent) to approve the revisions to the technical Manual; and voted unanimously 4-0 (Silk, Patterson and O’Brien absent) to recommend the site plan ordinance amendment to the City Council.

5. UNFINISHED BUSINESS

i. Request for Reconsideration of Site Plan Approval action taken at the previous meeting on June 28, 2011; 7 Residential Units (Harborview Townhouses) with a 19 space Parking Lot; 127 York Street Redfern Properties, Applicant. (7:00-8:00 p.m. - estimated time subject to change) The Portland Planning Board will hold a public hearing on a request for reconsideration of the Planning Board’s June 28, 2011 approval of a Level III site plan for a new 7 unit residential building and a 19 vehicle space parking lot at 127 York Street. If the Board votes to reconsider, the matter will be taken up as Unfinished Business.

6. NEW BUSINESS

i. Wind Ordinance Zoning Text Amendments; City of Portland, Applicant. (8:00-9:00 p.m. – estimated time subject to change) The Planning Board will hold a public hearing to consider a proposed ordinance, which allows various types of wind energy generation systems in most city zones, including residential, business, industrial and the Recreation Open Space Zones. The Planning Board will make a recommendation on the proposed ordinance to the City Council.

ii. Renewal of a Subdivision Sidewalk Waiver; Gertrude Street; Diversified Properties, Applicant. (9:00 p.m. – estimated time subject to change) The Portland Planning Board will hold a public hearing to consider a request by Diversified Properties for renewal of a subdivision waiver to waive the requirement for a sidewalk, which was previously granted to the Gertrude Ave. street extension and subdivision application.
