Rent Control & Rental Housing Rights
The Rent Control Ordinance, approved by voters in November 2020, went into effect January 1, 2021. It establishes a base rent of most rental units in Portland to the rent charged in June 2020, and caps the amount by which landlords may increase that rent annually. This ordinance is applicable to both long-term rental units and short-term rental units.
In addition, the Ordinance provides various protections to tenants, including notice of rent increases, additional notice or payments before evicting certain tenants, prohibiting discrimination on the basis of funding (such as Section 8 or GA), and notice of tenants’ rights to new tenants.
Lastly, this Ordinance established a Rent Board to conduct hearings in response to tenant complaints, mediate disputes between tenants and landlords, and consider landlords’ requests for rent increases outside the scope of this Ordinance.
City of Portland releases Allowable Increase Percentage and Tax Rate Rent Adjustment
In accordance with Portland City Code, Chapter 6, Sec. 6-234(a), on September 1 the Housing Safety Office is tasked with establishing and publishing the Allowable Increase Percentage and the Tax Rate Rent Adjustment for the following calendar year.
Based on the most recent available data from the Bureau of Labor Standards, from July 1, 2020 to July 1, 2021, the CPI-U for the greater Boston metro area advanced 4.3%. The Annual Increase Percentage for calendar year 2022 is 4.3%
Tax Rate Rent Adjustments are available if the City changes the mil rate as compared to the previous year and the property owner's taxes increase. The mil rate for the City has changed for this year, so landlords are eligible to to take the Tax Rate Rent Adjustments for 2022 if their taxes increased.
